IRENA System for Administration of Justice

Overview

The IRENA System for Administration of Justice is comprised of a two-level system made available to current and former IRENA staff members to appeal against administrative decisions taken by the Director-General directly affecting them, due to alleged non-observance of their terms of appointment.

The arbitration system, the second level, was established pursuant to the Assembly’s Decision on Administration of Justice at IRENA (A/3/DC/7). Staff members dissatisfied with the outcome of the internal appeals process may contest the final decision taken by the Director-General through arbitration in accordance with the IRENA Provisional Arbitration Rules (Arbitration Rules). Staff members must file a notice of arbitration and pay the applicable registration fee within 90 days of the date the final decision of the Director-General was communicated to them (Rule 3 of the Arbitration Rules).

IRENA Arbitration Panel

Arbitration cases are considered by a sole arbitrator selected by the staff member from a list of independent arbitrators approved by the IRENA Council, which constitutes the Arbitration Panel.

In accordance with Rule 7 of the Arbitration Rules, to be considered for inclusion on the Arbitration Panel, candidates must have experience in handling and resolving employment cases, preferably in the context of an international organization, either as member of a judicial or arbitral body or as a senior manager in an international organization; be familiar with issues and functions relevant to an international organization; be of good character; and have a reputation as a knowledgeable, fair and impartial individual. Due account must also be taken of the need to ensure geographical and gender balance among Panel members.

The current members of the Arbitration Panel were appointed by the Council at its twenty-fifth meeting (paragraph 163, C/25/SR/1).
